What the notice actually said

Twenty-five people sat at a table. Negotiated rulemaking (ELDTAC): six two-day sessions, February through May 2015, 25 industry, safety, labor, and state people plus FMCSA. Consensus in May 2015. That committee is why a Training Provider Registry later existed.

The March 2016 NPRM proposed national prerequisite training and a provider registry. MAP-21 was the statute. “Year of Partnerships” was Darling’s 2016 slogan. Commenters still got a say. The final rule followed in December.

Negotiated rulemaking is slower up front and faster to defend later. The NPRM is the public draft of that deal. Consensus is not a required hour count — that fight stayed in the final rule as proficiency-not-hours.

This is the proposal. The 2016 final rule is the live training standard. The 2022 TPR is the gate. The 2026 purge is later enforcement of the registry this NPRM imagined.

Who was at the table: carriers, safety groups, trainers, states, labor, insurance — 25 plus FMCSA. We did not sit on ELDTAC. We hire the output.

What it changes on Monday

We hire a CDL that a state issued after training that was supposed to be real. We did not sit on the committee, and we are not a school.

Final rule: 2016 ELDT. Gate: TPR launch. Later purge: 3,000 removed.
