What the notice actually said

January 1, 2003, the audit clock started. MCSIA 1999 spawned the original New Entrant interim final rule: demonstrate knowledge of driver qualifications, hours of service, testing, vehicle condition, accidents, hazmat; on-site audit inside 18 months.

Application certification plus an audit: data review, documents, interview. The agency’s theory was teach-then-verify, not “register and disappear.” Educational assistance is part of the design. Fail basic safety management and you do not get permanent authority.

Canada was included with U.S. new entrants in this IFR. About 40,000 applications a year were expected then. The 16-fail rule later made certain violations unforgivable on that audit.

This is the 2003 program design. The later 16 automatic fails are the teeth. Together they are why a two-week-old MC is not interchangeable with a 2012 authority.

You cannot skip the audit if you are a new entrant. We are not. A rented number trying to skip both this skeleton and the 16-fail teeth is the later “do not sell” file.

What it changes on Monday

PRIDEUSA already passed that era. A new MC quoting $1.50 under market is often still in this 18-month box. We pass. 16 fails and do not sell the number.
