What the notice actually said

A two-month-old MC quoting cheap is not a cheaper PRIDEUSA. FMCSA’s New Entrant Safety Assurance final rule: during the 18-month monitoring period, violating any one of 16 essential regulations is an automatic audit fail.

The 16 are the “you do not get to be permanently registered if you cannot do the basics” list: drugs and alcohol, hours of service, driver qualifications, vehicle condition, financial responsibility. A written corrective plan can be demanded.

Fail and you correct in the time FMCSA sets or registration can go. Roadside hits can trigger an expedited audit or a full compliance review. Serious equals compliance review. That is not a coaching service we sell to a stranger’s MC.

A flash MC with a rented USDOT is exactly what this rule and the later “do not sell numbers” notice are aimed at.

The 2003 program design is the skeleton — on-site audit within 18 months. This 2008 rule is the teeth. Together they are why a two-week-old authority is not interchangeable with a 2012 MC.
