What the notice actually said

Safety opened the query because that is the duty. MAP-21 required a national database of CDL drug and alcohol violations. The final rule made employers query before hire and annually.

MROs, SAPs, and TPAs report positives, refusals, and return-to-duty. Drivers consent before a full query. Go-live was January 2020, three years after the rule’s effective date.

Before the Clearinghouse, a driver could fail at Carrier A and start at Carrier B if B never heard. That hole is the point of the database. Consent and driver self-view at no cost are in the same rule.

A prior employer’s “he was fine” letter is not a substitute. The query is the query.

The 2026 IDEMIA wave is identity-proofing for professional users. It did not invent the query duty and it did not repeal 391.23. Registration how-to is a companion chapter; this page is the duty.

What it changes on Monday

We query. If the Clearinghouse is a no, we say no. A start date does not skip consent, and a Facebook screenshot does not skip the database.

Drivers in return-to-duty: the regulation, not a workaround. We will not invent a side channel because a candidate cannot finish the portal.

You still query yourself as the employer. The database does not care that you are also the driver.

Is this public gossip?
