What the notice actually said

A DMV counter in September 2025 did not wait for a comment cycle. Emergency action is how an agency moves faster than a full notice-and-comment rewrite, and the newsroom piece is the policy punch.

The Federal Register citation is what a lawyer will ask for: 90 Fed. Reg. 46,509 (Sept. 29, 2025). The stay is what a licensing shop actually ran on after mid-November 2025.

February 2026’s final rule is the later, more durable chapter. If a broker forwards only the September headline in 2026, send them this page and the final-rule desk note — two papers, two dates.

A stayed interim final rule is a court calendar. It is not a license to run a credential the state should not have cut.

Corrective-action states were the exception in the stay language: they still had to pause issuance until they showed they could follow the rules that existed before the IFR.

What it changes on Monday

We do not dispatch on a rumor that “the CDL rule is stayed so anyone can drive.” We look at the license in front of us and the text that is live this week.

If a candidate’s non-domiciled card sits in a corrective-pause state, that is a hire stop until the credential is real. A stayed IFR does not put a fake CDL back in a Volvo.

Hire file stays the same: valid CDL-A, Clearinghouse, miles. Read the February 2026 final rule next to this page, then apply if the card still exists.

Appointments and freight still move on legal trucks. Deferred loading if the window cannot be made legal.

Can states issue non-domiciled CDLs after the stay?

The newsroom notice says until further notice states were not prohibited by that IFR, except states already on a pause plan. Confirm the live FR text before you treat a 2025 headline as today’s rule.

Is the February 2026 rule the same paper?

No. Later final rule, different date. Do not mash the IFR and the final into one clock.

Does this change our Illinois empty?

Only if a specific driver is illegal. A stayed IFR does not embargo a legal Illinois CDL-A.
