What the notice actually said

MCSAP is how states pay for a lot of commercial-vehicle enforcement — officers, scales, the work that produces a sticker. When USDOT talks about withholding that money, it is talking to a state budget office, not rewriting a Lake Bluff rate confirmation. Keep that distinction or the headline turns into a fake West Coast surcharge.

The August 28, 2025 notices of proposed determination of nonconformity went to California, Washington, and New Mexico. USDOT said those three were not treating ELP as a real out-of-service item after the June 25 restart. The lever is up to 100% of MCSAP funding. The clock on the notices was 30 days to show enforcement.

The investigation’s evidence, as the department described it, was volume versus action: very few ELP OOS decisions relative to total inspections, and cases where another state’s ELP out-of-service was not honored. Washington was cited with thousands of inspections that found violations and only a handful of ELP OOS actions. That is a state-enforcement finding, not a new 49 CFR section.

Illinois is not on that list. Lake Bluff freight still runs through Illinois scales first. If your load is destined to Lathrop or Kent, you may feel West Coast inspection posture on that lane. That is a destination fact. It is not a change to our MC packet and it is not a reason to rewrite every Midwest quote.

Nonconformity is a formal process with a paper trail. It is not a social-media ratio and it is not the later California money chapter. The ~$40 million MCSAP withhold is a sequel. This page is the three-state warning.

What it changes on Monday

We do not collect MCSAP. We run legal drivers. If a West Coast receiver asks whether “the ELP thing” delays us, the honest answer is only if that specific driver is placed out of service. We do not staff mystery CDLs to save $100 on a rate, and we do not add a California-politics line item to a dry-van quote.

Monday’s hire file is still the same: a CDL we can verify, Clearinghouse, and English sufficient to do the job. That is true for a Joliet live-load and for a Kent delivery. The August 28 notices change how three states were being talked to about grant money. They do not change how we fill a seat.

What we will — and will not — do

We will run the lanes we can cover with a qualified driver. We will not invent an MCSAP fee, a three-state surcharge, or a lecture about grant formulas on a rate confirmation. Illinois is not California, Washington, or New Mexico in this notice.

We will not treat a funding fight as a reason to skip the hire bar. If a driver cannot meet 391.11(b)(2), that person is not on the truck — West Coast or not.
